Burrell v Clifford [2016] EWHC 578 (Ch)
Deputy Judge Spearman had awarded the Claimant £5,000 in damages for the unauthorised disclosure of private information contained within a letter Mr Burrell had sent him.
This decision dealt with the question of costs. -

The matter came before the Court of Appeal as to an issue on the applicable measure of damages in a professional negligence claim against their former solicitors.The Defendants were a firm of Solicitors who had admitted negligence acting for the Claimants in a property matter.The First Claimant, an experienced property developer and the Second Claimant bought a property together as a shared development project.

The Claimant. a well-known person, wanted to stop a Sunday newspaper from publishing an article about his extramarital affairs. The Judge refused an injunction, the main issue of the appeal was had he “properly balanced the competing rights which are in play”
